The term “Accessory Buildings and Structures” shall be defined as any structure that is to be erected or constructed upon one’s property within the city limits of Yates Center, Kansas, whether for storage, workshop, garage, pool house or whatever other use the property owner may want and desire.

Except as herein provided, no accessory building or structure shall project into a required yard setback along any street or alley.

Filling station pumps and pump islands may occupy the required yards; provided, however, that they are not less than fifteen (15) feet from the property line, and further provided that canopies and other similar coverings over the pups and pump islands shall have at least fourteen (14) feet of vertical clearance and shall not project beyond the property line.

Accessory, open and uncovered swimming pools and permanent barbeque grills may occupy a required rear yard, provided that they are not located closer than five (5) feet to the side or rear lot line. No alley may be used in meeting this requirement.

Accessory storm caves which are not a part of the main building may occupy a required rear yard, provided they are not located closer than five (5) feet to the side or rear lot line. No alley may be used in meeting this requirement.

All Accessory Buildings and Structures shall require a building permit. No Accessory Buildings and Structures may be erected, constructed, or replaced until said permit has been procured from the Zoning Administrator. The Zoning Administrator may allow minor deviations and adjustments relative to the dimensions set out in this Section where topographic or other natural features, utility locations, meters, trees, or preserved. A permit becomes null and void if work or construction authorized is not commenced within 180 days, or if construction or work is suspended for a period of 180 days at any time after work or construction is commenced. If a permit is null and void or expired, a new permit application is required. If work is begun without a permit, based upon City Council decision, judicial relief, including the seeking of an injunction and/or restraining order, is a possible remedy.
(a) BUILDING PERMIT REQUIREMENTS
A site plan including the following:
(1) Property address
(2) Property dimensions
(3) Existing or proposed structures and distances to property lines
(4) Locations of easements or rights-of-way
(5) Dimensions and materials of fence
(6) Distance from fence and property lines
(7) Setbacks shall be from the right-of-way

In the construction of any Accessory Buildings or Structures, no scrap building materials, such as barn metal, used lumber, or any other type of material that is unsightly, dangerous to adults, children or animals, or not otherwise approved prior to obtaining a building permit, shall not be permitted.
