Article 1. City Planning Commission/Board of Zoning Appeals

(a)   Pursuant to K.S.A. 12-744, there is hereby established a planning commission for the city consist of seven members.

(b)   The city governing body shall appoint two members for a term of one year, two members for a term of two years, two members for a term of three years, and one member for a term of four years, each to serve the term of appointment, and then the subsequent terms to be all for a period of four years.

(c)   Vacancies on the planning commission shall be filed by appointment of a new member by the governing body of the city.

(d)   The planning commission shall meet at such time and place as may be fixed by the planning commission’s bylaws, and at their first meeting shall elect one member to serve as chairperson, one member as vice-chairperson, and a person who may or may not be a member of the commission as secretary.

(e)   The commission shall adopt bylaws for the transaction of business and hearing procedures.

(f)   No action by the planning commission shall be taken except by a majority vote of the membership thereof.

(g)   A record of all proceedings of the planning commission shall be kept.

(h)   The planning commission shall have all powers and responsibilities as set forth by this article, the laws of the State of Kansas, and as may be given to the commission by the governing body of the city.

(i)    This article shall supersede and void all portions of previous ordinances, or the code of the city as may be inconsistent herewith.
