Except as allowed for hereafter, it is hereby required that the public water system for the City of Yates Center must be used for personal use in inhabited residences inside the City limits of Yates Center, Kansas. It is further required that all residences as are inhabited, may alternatively have water for personal use that is bacteriologically safe piped to the premises or the premises shall not be inhabited. It is also required that private water systems may not be connected for personal use at a residence, absent the water from that system being determined to be bacteriologically safe.

“Bacteriologically safe” is water that has been collected by the Health Officer designated by the governing body and analyzed by a certified laboratory that is determined to have no detectable fecal coliform in one hundred milliliters. A certified laboratory is a laboratory certified by the environmental protection agency or any EPA approved state water qualities certification procedures to conduct tests for specific parameters. There shall be annual certification to determine the continuing safety of water from private water system.
A “contaminated water” sample is a water sample which does not meet public drinking water standards. A water sample that does meet public drinking water standards for bacteria is defined as being bacteriologically safe water sample. No residences shall use water for personal use that has been deemed to have “contaminated water”
“Personal Use” means the use of water from a private water system for purposes including drinking, cooling, bathing and sewerage disposal.
“Private Water System” shall mean a private water well upon a property and the pipes involved in bringing water from a well to a residence in order to provide water for personal use at the residence.
“Public Water System” shall mean the City of Yates Center Municipal water treatment and delivery system as provides municipal water to residences.

No water well for use as part of a private water system, shall be constructed and used for personal use, as defined by this article, unless and until it has been certified as being initially bacteriologically safe and continues so thereafter.
Any existing water well shall cease to be used for personal use, if it is determined to have a contaminated water sample. The owner of any such well, as is used for personal use, shall on an annual basis request the designated Health Officer, to obtain the certification of a bacteriologically safe water sample having been drawn from this well. Absent that certification, all personal use of water from an existing well shall terminate and municipal water be used in its stead. The cost of such certification shall be paid by the owner or tenant using the well as part of a private water system.

It shall be unlawful for any person, firm or corporation including the owner or tenant of a residence to violate any of the provisions of this article. Upon a hearing before the Municipal Court and a determination of violation of this act, the party shall be obligated to obtain and maintain municipal water to the residence or alternatively to vacate the residence. The Municipal Court shall further have the discretion to impose a fine of up to $500.00 for a violation of this article, with each day subsequent to the determination of a violation, being treated as a separate and distinct violation, until the residence has been vacated or municipal water has been obtained for the residence.
