A CHARTER ORDINANCE EXEMPTING THE CITY OF YATES CENTER, KANSAS FROM THE REQUIREMENTS OF K.S.A. 12-1222 AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS FOR SAID STATUTE AND AMENDING YATES CENTER CITY ORDINANCE 12-303 OF THE MUNICIPAL CODE.

Section 1. The City of Yates Center by the power vested in it by Article XII of Section V of the Constitution of the State of Kansas hereby elects to exempt itself from the provisions of K.S.A. 12-1222 insofar as said statute requires that all members appointed to a library board be residents of the municipality.

Section 2. The following is hereby substituted for the provisions of K.S.A. 12-1222 requiring that all members appointed to a library board shall be residents of the municipality, to-wit:

(a)   The library board shall consist of seven members who shall be appointed by the mayor with the approval of the council.

(b)   Five of the seven members of the library board shall be residents of the City of Yates Center, Kansas.

(c)   Two of the seven members of the library board may be non-residents of the City of Yates Center, Kansas, but must be residents of Woodson County, Kansas.

Section 3. All provisions of section 12-303 of the municipal code of the City of Yates Center, Kansas, contrary to the provisions of this charter ordinance are hereby repealed, but all other provisions of section 12-303 of the municipal code of the City of Yates Center, Kansas, not in conflict with or contrary to the provisions of this charter ordinance are hereby confirmed and approved.
