A CHARTER ORDINANCE EXEMPTING LAW ENFORCEMENT COSTS OF THE CITY OF YATES CENTER, KANSAS FROM THE PROVISIONS OF K.S.A. 79-5001 TO 79-5016, INCLUSIVE BY AMENDING SECTION 2 OF CHARTER ORDINANCE NO. 3 AND REPEALING SECTION 2 OF SAID ORDINANCE; AND AUTHORIZING THE LEVYING OF TAXES TO CREATE A SPECIAL FUND FOR THE PURPOSE OF PAYING LAW ENFORCEMENT COSTS.

Section 1. That Section 2 of Charter Ordinance No. 3 is hereby amended to read as follows:

       The provision of K.S.A. 79-5001 to 79-5016, inclusive shall not apply to or limit the levy of taxes by the City of Yates Center for the payment of:

(a)   Principal and interest upon bonds and temporary notes;

(b)   No-fund warrants issued with the approval of the state board of tax appeals;

(c)   Legal judgments rendered against the city;

(d)   Rent due under any leave with a public building commission;

(e)   Special assessments charged against the city at large;

(f)   Utility service costs, whether paid from a separate property tax levy fund of the city or from any other tax supported fund;

(g)   Law enforcement costs, whether paid from a separate property tax levy fund of the city or from any other tax supported fund.

Section 2. Section 2 of Charter Ordinance No. 3 is hereby repealed.

Section 3. The City of Yates Center, Kansas is hereby authorized to levy a tax for the payment of law enforcement costs. As used in this charter ordinance, “law enforcement costs shall mean the city costs for salaries, equipment, commodities, and services necessary for the provision of police protection services to the City of Yates Center, Kansas.
