A CHARTER ORDINANCE EXEMPTING THE CITY OF YATES CENTER, KANSAS, FROM THE PROVISIONS OF K.S.A. 14-205 AND ALL AMENDMENTS THERETO, RELATING TO THE QUALIFICATION OF OFFICERS AND APPOINTMENT OF NON-RESIDENTS AS MUNICIPAL OFFICERS.
Section 1. The City
of Yates Center, Kansas, under the authority of Article 12, Section 5 of the
constitution of the State of Kansas, hereby elects to exempt itself and make
inapplicable to it, K.S.A. 14-205 and all amendments thereto, which apply to
aid city, which same provisions do not apply uniformly to all cities, and to
provide substitute and additional provisions on the same subject.
Section 2. All city
officers elected by the voters, shall be qualified electors of the City of
Yates Center, and the residents of same.
Section 3. All
appointed officers of the City of Yates Center, Kansas, shall be qualified
electors and residents of Woodson County, Kansas, except that the city may
appoint a non-resident of Woodson County, Kansas, to serve as city attorney,
but the city attorney must be a qualified elector of Woodson County, or of an
adjoining county.
Section 4. That
nothing herein shall authorize the appointment of non-residents of the State of
Kansas. The removal from the City of Yates Center, Kansas, of any elected
officer required to be a qualified elector shall occasion a vacancy in such
office. The removal from Woodson County of any such officer required to be a
qualified elector of Woodson County, shall occasion a vacancy in such office. The
removal from Woodson County or any such adjoining county by the city attorney
shall occasion a vacancy in such office.
Section 5. The city
clerk shall enter every appointment to office and the date thereof, on the
journal of proceedings. The city council may require all city officers, elected
or appointed, to take and subscribe an oath and give bonds and security for the
faithful performances of their duties.
