(a)   Emergency Preparedness is measures taken to minimize the probability or severity of disasters; the preparation for, and the carrying out of all emergency functions, other than functions for which military forces or other federal agencies are primarily responsible; and the prevention, minimization, and reparation of injuries and damages resulting-from disasters.

(b)   Disaster is the occurrence or imminent threat of wide-spread or severe damage, injury, or loss of life or property resulting from any natural or man-made cause, including but not limited to fire, flood, earthquake, wind, storm, epidemic, air contamination, blight, drought, infestation, explosion, riot, or hostile military or paramilitary action.

(c)   State of Local Disaster Emergency is a condition declared by the chairperson of the board of county commissioners or by the mayor upon finding that a disaster has occurred or the threat is imminent within the county or city.

(a)   The city hereby becomes legal member of the Woodson County emergency preparedness office for the purpose of assuming responsibility, as the disaster agency, of emergency preparedness and coordination or response to disasters.

(b)   The Woodson County emergency preparedness office, of which the city is a legal member, shall have jurisdiction within the city, as the disaster agency.

(a)   A state of local disaster emergency may be declared by the mayor upon a finding that a disaster has occurred or the threat thereof is imminent within the city.

(b)   No state or local disaster emergency shall be continued for a period in excess of seven days or renewed except with the consent of the governing body.

This article shall be subject to, but not limited by, state and federal laws presently in effect. Kansas law is K.S.A. 48-904 et seq. Federal law is: PL 812-920, PL 93-228, PL 94-361. All of the rights, powers, privileges, priorities, and protections embodied in the state and federal laws, enacted now or thereafter, may enlarge, expand, supplement, complement, amend or explain this article shall limit the specific provisions of the article.
